OBLIGATION OF INFORMATION IN RELATION TO THE CHANGE IN REGULATIONS RELATED TO DATA PROTECTION

In order to protect the processing of your personal data, following the amendment of the provisions on the protection of personal data and the entry into force on 25 May 2018 of Regulation (EU) No 2016/679 of the European Parliament and of the Council of 27/04/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of European Union L 19, p.1) - hereinafter referred to as "GDPR", we would like to inform you that a special e-mail address has been activated: daneosobowe@fadesapolnord.pl, to which you can address questions related to the processing of personal data, as well as requests in order to exercise your rights. Jerozolimskie 94, entered into the Register of Entrepreneurs kept by the Regional Court for the capital city of Warszawa, XII Commercial Division, under KRS number 0000235595, e-mail: daneosobowe@fadesapolnord.pl (hereinafter: FPP) is the personal data controller of the individuals who:

  1. concluded agreements with the FPP, also before 25 May 2018, or undertook activities aimed at concluding such agreements.
    Your personal data is processed for the purpose of concluding and performing the contract(s), and the legal basis is Article 6(1)(b) of the GDPR (i.e. the conclusion and performance of the contract).
    The provision of personal data is voluntary but necessary for the purpose of the processing.
    Your personal data will be processed until the statute of limitations of your contractual claims expires.
  2. are interested in receiving commercial communications from the FPP, if they have given their consent for such processing.
    Your personal data are processed for the purpose for which you have given your consent and the legal basis for the processing is Article 6(1)(a) of the GDPR (i.e. the consent granted).
    The provision of personal data is voluntary but necessary for the purpose of the processing.
    Your personal data will be processed until the withdrawal of your consent. You have the right to withdraw your consent at any time. Withdrawal of consent to the processing of personal data shall not affect the lawfulness of the processing carried out on the basis of the consent prior to the withdrawal. In order to withdraw your consent, you must send a letter or e-mail to the FPP address indicated above.
  3. Furthermore, FPP processes personal data necessary for the purposes of the legitimate interests pursued by the FPP, i.e. for the purpose of examining possible claims, and the legal basis for such processing is Article 6(1) (f) of the GDPR (i.e. the legitimate interests pursued by the controller).
    The legitimate interest of the FPP is to examine possible claims.
    With regard to the processing of your data on the basis of the legitimate interests pursued by the FPP, i.e. for the purpose of examining possible claims, you have the right to object, for reasons related to your particular situation.
    Your personal data will be processed for as long as is necessary for the purpose of the processing mentioned above, i.e. until it is fulfilled or until you object to such processing, unless there are legitimate grounds for further processing.

Further information

The recipients of personal data may be IT companies, real estate agents, and in the case of data processing for the purpose of concluding a contract - also entities providing accounting services, legal services (including notaries), postal operators and couriers, as well as other entities performing obligations under the concluded contracts on behalf of FPP (e.g. contractors for construction works covered by the warranty, architectural studios, real estate administrators). Personal data may also be disclosed to competent authorities, in accordance with applicable laws. Your personal data will not be transferred to a third country (i.e. outside the European Economic Area). The data subject shall not be subject to automated decision making, including profiling. According to the GDPR, you have the right to request from FPP access to your personal data, to rectify, delete or limit the processing, as well as the right to transfer the data to another controller. You also have the right to file a complaint with the data protection supervisory authority.
